Terms of Service

1. Acceptance of Terms

By accessing or using FinStore ("the Platform", "we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. FinStore is operated by FinStore Technologies and is designed for merchants and businesses in Nigeria and Africa.

2. Description of Service

FinStore provides an e-commerce platform that allows merchants to create online stores, manage products and inventory, process customer orders, and accept payments through integrated payment providers including Fintava. The Platform is available via web and mobile applications.

3. Eligibility

To use FinStore, you must:

  • Be at least 18 years of age.
  • Be a registered business or individual operating lawfully in Nigeria or your country of residence.
  • Provide accurate, complete, and up-to-date registration information including your BVN and/or NIN where required for KYC compliance.
  • Not have been previously suspended or removed from the Platform.

4. Merchant Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@finstore.africa of any unauthorised access to your account. FinStore is not liable for any loss or damage arising from your failure to safeguard your account.

Each merchant account is for a single business. Creating multiple accounts to circumvent fees, restrictions, or verification requirements is prohibited and may result in account termination.

5. Payments and Fees

FinStore facilitates payments through Fintava. By accepting payments on the Platform, you also agree to Fintava's terms of service. FinStore may charge transaction fees or subscription fees as disclosed in your merchant dashboard. Fees are subject to change with 30 days notice.

Withdrawals of funds are subject to verification, and FinStore reserves the right to hold funds for up to 7 business days in cases of suspected fraud or chargeback risk.

6. Prohibited Activities

You agree not to use FinStore to sell or promote:

  • Counterfeit, stolen, or illegal goods.
  • Weapons, explosives, or controlled substances.
  • Pornographic or sexually explicit material.
  • Products that infringe on third-party intellectual property rights.
  • Services that facilitate money laundering, fraud, or other financial crimes.

Violation of these prohibitions may result in immediate account suspension, forfeiture of funds, and referral to law enforcement authorities.

7. Customer Data and Privacy

As a merchant, you collect personal data from your customers (names, addresses, payment details). You are responsible for handling this data in compliance with applicable Nigerian data protection laws including the Nigeria Data Protection Act (NDPA) 2023. You must have a published privacy policy on your storefront.

8. Intellectual Property

FinStore and its logos, design, software, and content are the intellectual property of FinStore Technologies. You are granted a limited, non-exclusive, non-transferable licence to use the Platform solely for its intended purpose. You may not copy, modify, reverse-engineer, or redistribute any part of the Platform.

9. Limitation of Liability

To the maximum extent permitted by law, FinStore shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Platform. Our total liability to you for any claim shall not exceed the fees paid by you in the three months preceding the claim.

10. Termination

FinStore reserves the right to suspend or terminate your account at any time for breach of these Terms, fraudulent activity, or for any reason with 14 days notice. Upon termination, your access to the Platform and your store will be disabled. You may request an export of your store data within 30 days of termination.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved by the courts of Lagos State, Nigeria, or through arbitration as agreed by the parties.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice in your merchant dashboard. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
